Assumption of Risk & Waiver of Liability

Heart of the Village Yoga llc (HOTV Yoga) offers instruction in various yoga practices, strength training, aerial yoga, and other mindfulness-based activities, indoors and outside in nature, in person and online. I understand that all HOTV Yoga activities include physical movement, participation in breathing and meditation techniques, as well as opportunities for relaxation, stress reduction, and relief of muscular tension.

I understand that none of the HOTV Yoga activities are a substitute for medical attention, examination, diagnosis or treatment, and that they are neither recommended nor safe under certain medical conditions. By my signature below, I acknowledge that participation in any of the HOTV Yoga activities exposes me to a possible risk of personal injury, including death. My signature below further constitutes my certification that I am physically fit to participate in the HOTV Yoga activities for which I have registered and that a licensed medical doctor has verified my physical condition for participation in this type of class.

As is the case with any physical activity, the risk of injury is always present and cannot be entirely eliminated. If I experience any pain or discomfort, I will listen to my body, adjust my posture and ask for support from my HOTV Yoga teacher. I will continue to breathe smoothly. If at any point I feel overexertion or fatigue, I will respect my body’s limitations and I will rest until I am ready to resume my participation in class. By my signature below, I voluntarily assume all risk, including the risk of death or serious bodily injury, of participating in any of the HOTV Yoga activities.

I am fully aware of any risk of injury and, by my signature below, I hereby consent to receive medical treatment that may be deemed advisable in the event of injury, accident and/or illness during my participation in any of the HOTV Yoga activities.

If I am pregnant or become pregnant or am post natal, my signature below further verifies that I am participating in any of the HOTV Yoga activities with my doctor’s full approval and that I voluntarily assume the risk of participating in class.

If I am practicing remotely via an online live-streaming class or following a recorded class, my signature below verifies that I voluntarily assume responsibility for the safety of the physical space in which I practice and of the equipment (resistance bands and weights, suspension devices, aerial swings, supporting structures) that I use during class.

I also understand that I may be photographed while participating in HOTV Yoga activities. My signature below indicates my agreement to allow my photo, video or film likeness to be used for any legitimate purposes by Heart of the Village Yoga llc.

I take action for myself, my executors, administrators, heirs, next of kin, successors and assigns by hereby irrevocably indemnify, waive, release, hold harmless, and discharge Heart of the Village Yoga llc, its directors, officers, employees, volunteers, representatives and agents from any and all liability for my death, disability, personal injury, property damage, property theft or actions of any kind which hereafter may occur to me while participating in activities in person or online.

My signature further acknowledges that I shall not now or at any time in the future bring any legal action against Heart of the Village Yoga llc, its directors, officers, employees, volunteers, representatives and agents and that this waiver is binding on me, my heirs, my spouse, my children, my legal representatives, my successors and my assigns.

I hereby certify that I have read this document and understand its content. I am aware that this is a release of liability as well as assumption of the risk, and I sign it of my own free will.
